A4 in Shop for 5 months...need advice
So here's my problem:
-Was involved in an accident on Jan 10th. Dude slid across the road and hit me head on, crumpled drivers side bumper, fender, and hood. Not terrible damage but enough to make the car undriveable.
-I'd had some work done at Calgary Collision and Coachworks before, they were good and phoned them to see if they were super busy or not. THey said pretty busy but shouldn't take more than 3 weeks. They pick up my car with a flatbed on January 14th. Adjustors estimated 11000 for repair. WHy wouldn;t they just give me book value for a 02 A4?
- After 1 month passed I became concerned as insurance only pays for rental for one month. $45 per day after. I called shop and owner said, not to worry, we will pay for the rental.
- 2 months pass, I call back weekly. Car is near done only a few finisihing touches etc. etc... SHould be back next week.
- 3 months, 4 months, almost 5 months now.
- I'm really concerned as the owner has fed me so many lines. He said my car was reassembled and waiting clearcoat. Then he said he had sent it in for an inspection. One day I went down to his lot without telling him and there was my car sitting in pieces with no front clip. He told me it went out to inspection the week before! I checked back again this past week and the car is in the same place with noi work done to it. Now the bill for the rental is up to $5000. He's said all along that he will take care of it but I'm getting stressed. Not to mention the fact that I'm driving a chevy gocart or cobalt or whatever it's called.
I'm preparing for a battle when it comes to delivery time as there's no way I'm paying for this. Anyone have any advice or similar situations? What can I do legally to get my car back and have him foot the bill for the rental. From what it looks like, my car has not been touched in 4 months.

i had something similar happen to me like this. it wasnt as extensive as your situation, but enough to get me worried about having to pay for the car rental fee.
i called my insurance and told them that my car isnt ready after being told by the shop that it was going to be ready at this date. They understood my situation and said that they will contact the shop and asked them what reasons they had for not having the car ready. They requested for proof that it was due to parts out of stock. Then i also called the shop stating that i am not willing to pay for the rental fee.
Luckily, my adjuster said they'll cover one extra day. Any extra days, the shop spoke with the rental company to waive it off..Then again, this was only a few days late. I will never deal with this shop again. I wasnt too happy with the results.
avoid Atlantic Collisions @ Wolfedale Road , Missisauga Ontario.
Friendly people with lousy hands. Even the front desk was a ditz.

I had a similar situation with the Ottawa Marks motors shop. They did a fantastic job, but it took longer then expected. In the end I too keept the insurance company in the loop, and the additional days were taken care of by insurance... State farm has treated us very well.

Unfortunately I've waited too long to inform my insurance company that the Shop has taken so long with my car. The rental bill is up to $5000 over and above what is covered by insurance ($1200). All along the shop owne has promised that the lag is his fault and that he will be paying for any rental car fees. Although he has only told me that over the phone, I have nothing in writing. Now I'm going to get screwed for this bill.
These guys were great when I took them my last car, no problems at all. I'll post the results here in the hopes that someone will learn from this and not get burned like this. I'm not looking forward to the outcome.

ouch thats harsh man, i am pretty sure you can do something about it, you might want to ask authorities maybe they can help if the guy becomes uncooperative...
